Maryland Non-Resident Real Estate Withholding Tax Requirements Are you selling property in Maryland but reside out of state? Maryland law requires a mandatory tax withholding at settlement on the sale of real property by non-resident individuals and entities. As of January 1, 2026, the statutory withholding rates are 8.75% for individuals, estates, and trusts, and 8.25% for business entities (including LLCs and Corporations). How to Apply for an Exemption If you expect to make no capital gain on the sale, or if you qualify for a special situation (such as a 1031 Exchange or a former principal residence), you can apply for a full or partial exemption. To apply, you must complete and submit Maryland Form MW506AE (Application for Certificate of Full or Partial Exemption). ⚠️ Crucial Deadline: The Comptroller of Maryland must receive your completed Form MW506AE and all supporting financial documents no later than 21 days prior to your closing date. The state enforces this timeline strictly; applications submitted under the 21-day window cannot be guaranteed processing before settlement, requiring the title company to collect the full withholding amount at closing. Once approved, the Comptroller will issue a Certificate of Exemption, which you must provide to Cole Title & Escrow before or at closing so we can adjust or waive your withholding.

🚜 Agricultural & Farm Settlements in MD, DE, and PA Closing a Farm Requires More Than Just a Standard Settlement. Settling agricultural property isn't like closing a suburban subdivision home. Farm transactions involve complex zoning laws, unique tax classifications, and multi-generational land protections. A single overlooked detail can cost buyers or sellers thousands in unexpected penalties. At Cole Title & Escrow, we have been managing complex agricultural real estate transactions across Maryland, Delaware, and Pennsylvania since 2006. Led by founder Michelle Cole, our team brings decades of specialized title experience directly to your kitchen table or barns. ________________________________________ 🌾 Navigating the Complexities of Ag Settlements We actively handle the technical legal hurdles unique to operational farmland, including: •Agricultural Use Assessments: Maryland’s preferential Agricultural Use Assessment shields working farmers from skyrocketing property taxes based on market value. We ensure your transfer paperwork preserves this status flawlessly. •Agricultural Transfer Taxes (ATT): If land is converted out of agricultural production, steep state and county tax penalties apply. We carefully analyze state databases to flag Agricultural Transfer Tax obligations well before settlement. •Conservation Easements & METs: Farmland often carries restrictions from the Maryland Environmental Trust (MET) or local agricultural preservation boards. We map out exact easement boundaries and rules governing your property. •1031 Tax-Deferred Exchanges: Looking to reinvest farm sale profits into a new income-producing property? Through our partnership with Continental 1031 Exchange Services, we act as your dedicated exchange manager to defer capital gains tax. •Water Rights, Tenant Leases, & Outbuildings: We clear titles regarding active crop leases, timber rights, shared agreements, and unrecorded agricultural structures. ________________________________________ 🛡️ Why Tri-State Farmers Trust Cole Title & Escrow The Cole Farm AdvantageWhat This Means For Your Transaction Tri-State LicensingSeamlessly handling cross-border farm portfolios in MD, DE, and PA.
